Patna HC refuses anticipatory bail for accusation of posting vulgar photographs of goddess on social media

Patna, August 4, 2021: The Patna High Court has denied anticipatory bail to two men who allegedly clicked obscene photographs with an idol of Goddess Saraswati and posted them on social media. 

A Bench of Justice Sudhir Singh rejected the anticipatory bail pleas of the applicants and said that if they surrender, bail at the trial level might be considered. 

The prosecution’s case was that the accused persons took very vulgar and obscene photographs with a statue of Goddess Saraswati and made it viral on a social media platform. 

The counsel for petitioners, however, denied the allegation contending that the petitioners have got no criminal antecedents and they have been falsely been implicated. 

The counsel for the State submitted that the petitioners were named in the FIR and were also involved in uploading such vulgar photographs of the idol of Saraswati on social media. 

After considering the arguments, facts and circumstances, the High Court refused to grant anticipatory bail to the petitioners. 

The High Court, however, clarified that if the petitioners surrender before the trial court and pray for regular bail, the same shall be considered on its own merit without being prejudiced by this order.
