New Delhi, July 25, 2023: In a recent development, the Orissa High Court has provided interim relief to M/s. Chirag Industries (petitioner) in a GST-related case, directing that no coercive action should be taken against them during the pendency of the writ petition. The court's decision safeguards the petitioner from any enforcement measures regarding the disputed GST demand while the case is being heard.
The petition was filed in response to a demand for penalty and fine, as confirmed in the first appeal order. The court entertained the petition as the Second Appellate Tribunal had not yet been constituted. The petitioner's counsel informed the court that they intended to file an appeal before the appellate tribunal once it was formed.
In light of this submission, the court ordered that no coercive action be taken against the petitioner regarding the disputed demand during the pendency of the writ petition.
