Chandigarh, June 1, 2022: In response to a plea by Ajay Pal Singh Middukhera, the elder brother of deceased Youth Akali Dal leader in whose murder case he is the sole eye witness, the Punjab and Haryana High Court has directed the State and the other respondent-authorities to look into the representations made by the petitioner before them on sensing threat to the security of his life at the instance of his brother’s murderers. 

The Bench of Justice Karamjit Singh has held, “In the meantime, respondent No.2 is directed to look into representation (Annexure P-11) and assess threat perception and if the situation so warrants to do the needful in accordance with law and to submit its report in this regard by the next date of hearing.”

The Court was delaing with a petition by Ajay Pal Singh Middukhera seeking directions to the respondent-authorities to provide proper security to the petitioner as he was perceiving threat to his security at the instance of those who murdered his brother Vicky Middukhera who was leader of Youth Akali Dal (YAD). 

The petitioner was the sole eye witness in the murder of his brother in respect of which an FIR under Sections 302, 34 IPC and Sections 25 and 27 of Arms Act was registered at Police Station Mataur, District SAS Nagar. 

It was the case of the petitioner that representation was already given by the petitioner in this regard but the same was not considered, thereafter, another representation was given by him to the second respondent in this context but till date, the authorities failed to take appropriate measures and failed to provide any protection or security to the petitioner. 

On notice, Ms. Samina Dhir, DAG, Punjab, on behalf of the State prayed for time to seek necessary instructions and to file a reply. 

Thus, the matter was postponed by the Court to August 18, 2022, and in the meantime, the second respondent was directed to look into representation and assess threat perception and if the situation so warrants, to do the needful in accordance with law and to submit its report in this regard by the next date of hearing.
