Chennai, September 14, 2022: In a case of drunk driving where a man was arrested and remanded to judicial custody for the offences punishable under Sections 308, 337 of IPC r/w 184, 185 of Motor Vehicles Act as he drove his vehicle in a rash and negligent manner when he was in an inebriated condition, the Madras High Court has asked him to distribute pamphlets against "Drunken Driving" for two weeks  as a bail condition.

 

The petitioner approached the Bench of Justice A.D.Jagadish Chandira and sought bail while contending that as per the prosecution, the victims had been discharged from the hospital. It was submitted that had been in prison from August 23, 2022 and he had to take care of his family. 

 

The State, on the contrary, opposed the grant of bail to the petitioner by stating that the petitioner, who had driven the vehicle in a rash and negligent manner in an inebriated condition, had dashed against three persons, caused injuries and fled away from the scene of occurrence.

 

Taking into consideration the facts and circumstances of the case and the submissions made from the petitioner’s side, the Bench was inclined to grant bail to the petitioner by imposing certain conditions.

 

It was ordered by the Bench that the petitioner would be released on bail on his executing a bond for a sum of Rs 25,000 while also directing the petitioner to report before the respondent-Police and he shall distribute the pamphlets against "Drunken Driving" for a period of two weeks.
