New Delhi, September 20, 2023: In a recent order, the Delhi High Court has quashed an FIR registered under various sections of the Indian Penal Code, after the parties involved reached a compromise.

 

The present petition under Section 482 of the Code of Criminal Procedure, 1973, was filed, seeking the quashing of an FIR registered under Sections 406, 420, 467, 468, 469, 471, 120B, and 34, IPC. The petitioner also sought the quashing of all proceedings arising from the said FIR. This request was based on a compromise deed dated 28.08.2023, which had been mutually agreed upon by the parties involved.

 

The prosecution stated that they had no objections to the quashing of the FIR in question. Respondent no. 2 also affirmed the compromise deed, indicating their voluntary settlement of all disputes with the petitioners. They further stated that they did not wish to pursue the criminal proceedings against the petitioners and had no objection to the quashing of the FIR.

 

The single-judge bench of Justice Saurabh Banerjee noted that since a settlement had been reached between the parties and the opposing party did not wish to proceed with the criminal proceedings, continuing with the mentioned FIR would serve no purpose.

 

Accordingly, the court allowed the petition, quashing the FIR and all proceedings arising from it.

 

However, the petitioners and respondent no.2 were required to deposit a cost of Rs.24,000 each, totalling Rs.48,000. The total cost of Rs. 48,000 would then be used to purchase uniform socks for police personnel stationed at six police stations in equal proportions.
