HC grants police protection to wife against her drug addict husband

Chandigarh, July 8, 2021: The Punjab and Haryana High Court has granted police protection to a woman against her drug addicted husband.

The High Court granted relief to the woman, a resident of Punjab’s Kapurthala town, in response to the petition filed by her saying that she is married and has three daughters born out of this wedlock but her husband is a drug addict who harasses and maltreats her.

Due to this reason, she left her matrimonial home along-with her daughters and started living at her parental home. But after some time, she left that place also her parents were not willing to keep her with them, she said in her plea.

The petitioner informed the court that presently, she was residing alone with her daughters in a rented accommodation but her family members were pressuring her to join the company of her husband.

The woman sought that the court issue a direction to the local police to protect her life and liberty as she apprehended a threat to the same from her father, mother, brother, brother’s wife and husband.

The Bench of Justice Meenakshi I Mehta, keeping in view the prayer as made by the petitioner’s counsel and without expressing any opinion on the merits of the matter, directed Senior Superintendent of Police, Kapurthala, to look into the complaint/representation of the petitioner. 

“If it is found that the petitioner genuinely deserves any protection, then to take appropriate action in accordance with law,” the Bench said.

“It is further clarified that this order shall not be construed to be a shield to the petitioner against any proceedings already initiated or intended/contemplated to be initiated by the competent authority/person on account of the afore-discussed facts and circumstances and permissible under any relevant provisions of law. This petition stands disposed of accordingly,” stated the HC.
