Centre files review petition against SC’s verdict striking down Maratha reservation

New Delhi, May 14: The central government has moved a review plea in the Supreme Court urging the court to reconsider its verdict in the Maratha reservation case.

On May 5, the apex court had struck down reservation for the Maratha community in education and jobs in Maharashtra. The court quashed the Maharashtra SEBC Act (2018) and said reservation for forward castes is unconstitutional and violates the right to equality.

The Maharashtra government’s decision to declare the Maratha community as a socially and educationally backward class (SEBC) was also struck down, as reported by India Today.

The court had said, “The 2018 Maharashtra state law violates right to equality. We won’t re-examine the 1992 verdict which capped reservation at 50%. There is no valid reason to breach the 50% ceiling to give reservation to Marathas”.

The case reached the Supreme Court when several petitions challenged the Bombay High Court verdict which upheld the grant of reservation to Marathas in admissions and government jobs in Maharashtra.
