Chandigarh, October 27, 2021: The Punjab and Haryana High Court has opined that senior citizens are entitled to get their cases decided on preferential basis and expeditious trial is right of every litigant.
Herein, the petitioner-Gurmeet Singh, aged about 67 years, had filed an ejectment petition against the respondent/tenant Vipan Kumar on the ground of arrears of rent and personal necessity, which petition has been pending before Rent Controller, Ludhiana.
The grouse of the petitioner/landlord was that the proceedings in that rent petition have been going at a very slow pace and since he is a senior citizen, therefore proceedings be ordered to be expedited.
The Bench of Justice H.S.Madaan observed that senior citizens are entitled to get their cases decided on preferential basis.
The Bench noted that on account of extraordinary situation, which had arisen due to the outbreak of Covid-19, the proceedings in the Courts had been seriously affected. Nevertheless situation has improved to a large extent now.
Hence, Justice Madaan directed the Rent Controller, Ludhiana to make earnest efforts to conclude the proceedings in the rent petition and dispose it of expeditiously preferably within a period of one year from the date of receipt of copy of the order in the Court.
