PepsiCo takes Parle Agro to court over usage of ‘For the Bold’ tagline

June 16, 2021: PepsiCo has filed a trademark violation case against Parle Agro over the use of ‘For the Bold’ tagline for its newly launched beverage B Fizz.

‘For the Bold’ is a registered trademark for the Doritos nacho chips brand globally, the US beverage and packaged food multinational argued in its petition filed in the Delhi High Court earlier this month. PepsiCo has pleaded that the court restrain the Mumbai-based beverages company from “infringement, passing-off, dilution and unfair trade competition”, and sought around Rs 2 crore in damages, court documents show, as reported by The Economic Times.

The court has ordered Parle Agro to file a written response within a month and fixed the next date of hearing on July 17. On June 3, the Delhi HC, while granting an ex-parte order of ad-interim injunction restraining Parle Agro from using the tagline, also asked the company to file its response within 30 days, CNBC TV 18 reported.

The maker of Bailley water and Frooti juices launched B Fizz, a fruit juice-based beverage, in October last year. Cans and bottles of the beverage come with a tagline ‘Be the Fizz. For the Bold.’ The fizzy drink is being promoted by celebrity Priyanka Chopra Jonas.

Doritos is a $1-billion-plus brand that is one of the fastest growing snack brands in the New York-based giant’s portfolio, according to the company. In 2017, PepsiCo announced that it is producing Doritos in India at its snacks manufacturing facility in Kolkata, reported The Economic Times.
