Karnataka HC extends operation of all interim orders till Aug 2

Bengaluru, July 5, 2021: The Karnataka High Court has said that all interim orders passed by the High Court (Principal Seat and Benches at Dharwad and Kalaburagi), all the District Courts, Civil Courts, Family Courts, Labour Courts, Industrial Tribunals and all other Tribunals in the State, which were due to expire between April 17 and May 29, 2021, will continue to operate till August 2, 2021.

While listing the petition on July 6, the High Court cleared that any orders of eviction, dispossession or demolition that have been passed by the High Court, District Courts or Civil Courts, shall remain in abeyance till August 2, 2021.

However, in the order dated July 2, the High Court made it clear that any litigant desirous of applying for vacating the interim orders, will be permitted to apply to the concerned Courts/Tribunals praying for the same. In pursuance thereto, the Courts/Tribunals are not restrained by continuation of interim reliefs granted by the High Court, if any such application are made by the litigants concerned, the bench said. 

In addition, the High Court directed that interim orders of bail and pre-arrest bail passed by various Criminal Courts in Karnataka which were likely to expire between April 23 and May 29, 2021 shall stand extended to August 2, 2021. 

However, irrespective of the same, the concerned Courts are permitted to hear such applications made by the State or prosecuting agency or by any person for cancellation of the bail.
